Completion of Agreements
This agreement between FELO Moto Italy srl (Seller) and the buyer (Customer) is deemed finalized upon confirmation of the order by the Seller according to the methods and terms set forth in the following Article. Finalization of the agreements implies the Customer's review and full acceptance of these general conditions of sale. If the Customer is a consumer, once the online purchase process has been completed, he or she will print or save an electronic copy, and in any case retain these general terms and conditions of sale, in compliance with the provisions of the distance selling regulations.
Purchase Methods
The Customer may purchase only the products listed in the online catalog at the time of placing the order and viewable online at shop.felomoto.eu, as described in the relevant information sheets. The order will be processed upon receipt of confirmation of payment for the order in the email address provided by the Customer. Correct receipt of the order is confirmed by the Seller via email, sent to the email address provided by the Customer. This confirmation message will contain an order number to be used in all further communications with the Seller. The message will contain all the data entered by the Customer, all information regarding the essential characteristics of the item, the price, payment methods, and delivery methods and costs. The Customer must verify the accuracy of the information and promptly communicate any corrections to Customer Service, according to the procedures described in this document. In the event of non-acceptance of the order, the Seller guarantees prompt notification to the Customer.
Prices
The products will be sold at the list prices in effect at the time of the Customer's order, net of shipping costs, which are calculated at the time of the order.
All prices indicated for products available on shop.felomoto.eu for countries within the European Union are inclusive of VAT.
All prices indicated for products available on shop.felomoto.eu for countries outside the European Union are exclusive of VAT and any import duties and taxes.
Shipping prices include VAT.
Order Preparation
From the moment the Customer places an order on shop.felomoto.eu, the time required to prepare and ship the purchased items depends on product availability. Availability and order preparation times are indicated on the website for each product. The term "Shipping within 24/48 hours" indicates the time required to process the order and prepare the package, before shipping it. The courier typically delivers in Italy within 24/48 hours of shipment and in Europe within 72/96 hours of shipment. The term "Delivery within 24/48 hours" indicates the time required for delivery within Italy, excluding islands and remote areas. In the case of a multiple order, shipping may occur once the order is complete, that is, after all the ordered products have been obtained. For example, if these include products marked "On Pre-Order" on the product page, the order may be processed when those products become available. If, during the order processing phase, a product is no longer available because it is out of stock or unavailable, the customer will receive an email informing them of the inconvenience and the order will be updated to remove the unavailable item. The other products will be shipped, and the cost of the unavailable item will be automatically deducted from the total purchase price indicated during checkout. Regardless of the payment method chosen and in the case of advance payment, the customer will be refunded the value of the missing item.

The photos of the products for sale on the website are for illustrative purposes only. The manufacturer reserves the right to make changes to the products compared to the photographs on the website without prior notice. The Seller will make every effort to update product photos based on these changes.
Statutory Warranty – Conventional Warranty – Defective Goods
We invite you to review the applicable legislation on the Legal Guarantee ("Consumer Code" – art. 128 et seq.VAT of the Civil Code), which certifies that consumers are guaranteed conformity for two years from delivery of the product, upon presentation of the invoice/purchase receipt.
Batteries have a 12-month warranty, while product components subject to wear and tear are not covered by the warranty.
The warranty is only one year for those purchasing as non-consumers but as entrepreneurs or professionals, providing their VAT number and requesting an invoice.
FELO Moto Italy srl acts as an intermediary appointed by Felo Moto Italy Srl for the online sales of vehicles, spare parts, and accessories. The warranty on purchased vehicles/goods is provided directly by FELO Moto Italy srl - Via O. Respighi, 52 - 47841 Cattolica (RN) - VAT no. 03922900125
Right of Withdrawal
In accordance with the laws on e-commerce, if the Customer is a consumer (i.e., a natural person who purchases the goods for purposes not related to their professional activity, or who does not provide a VAT number to the Seller on the order form), they have the right to withdraw from the purchase contract for any reason, without having to provide a reason and without penalty, except as indicated in the following paragraph. To exercise this right, the Customer must send the Seller written notice to that effect within 14 days of receiving the goods. This notification must be sent by letter addressed to:

or by telegram or email to customercare@shop.felomoto.eu, always sent within the aforementioned 14-day period. Once the aforementioned notice of withdrawal is received, the Seller's Customer Service will promptly provide the Customer with instructions on how to return the goods, which must be returned by the Customer and received by the Seller within 14 days of authorization. The right of withdrawal is subject to the following conditions:
- The right applies to the purchased product in its entirety;
- The purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation, etc.);
- Attaching labels or adhesive tape directly to the original product packaging must be avoided in all cases;
- Shipping costs for returning the item are the responsibility of the Customer. For returns from non-EU countries, all costs related to transportation, customs clearance, and VAT are the responsibility of the consumer;
- Shipping, until confirmation of receipt in our warehouse, is under the complete responsibility of the Customer.
Submission of the return request by the Customer according to the methods described above and the relevant authorization via email from the Seller are a prerequisite for the return to be accepted. The return authorization sent to the Customer by the Seller contains the warehouse address to which the returned goods should be sent. The Seller reserves the right to refuse unauthorized returns that do not comply with these return conditions. The goods will therefore be returned to the Customer at the original shipping address.
In the event of damage to the goods during transport, the Seller will notify the Customer of the incident (within 5 days of receiving the goods at its warehouse), allowing the Customer to promptly file a complaint with the courier of their choice and obtain a refund for the value of the goods (if insured). In this case, the product will be made available to the Customer for return, simultaneously canceling the withdrawal request. The Seller is not responsible in any way for damage or theft/loss of goods returned via uninsured shipments. Upon arrival (at the warehouse), the product will be inspected for any damage or tampering not resulting from transport. If the packaging and/or original wrapping are damaged, the Seller will withhold a percentage, no more than 10% of the refund due, as a contribution to the repair costs, or may refuse the return. Except for any repair costs for confirmed damage to the original packaging, the Seller will refund the Customer the full amount already paid, excluding shipping costs. The refund will be made within 14 days of the return of the goods. The refund will be processed by the Seller, based on the payment method used when placing the order, viaand the refund of the amount due, which will be paid to the credit card or PayPal account used at the time of the order, or by bank transfer to the account provided by the Customer upon express request by the Seller. The right of withdrawal is forfeited entirely, due to the lack of the essential integrity of the item (packaging and/or its contents), in cases where the Seller finds:
- the absence of the original external and/or internal packaging;
- the absence of integral elements of the product (accessories, parts, etc.);
- damage to the product for reasons other than transportation;
- damage to the original packaging;
- the removal of labels, tags, and/or security seals.
In the event of forfeiture of the right of withdrawal, the Seller will return the purchased item to the sender, charging the sender the shipping costs. Any complaints must be addressed to:

Applicable Law and Jurisdiction
This contract is governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this contract, if the Customer is a consumer, the competent court of his/her municipality of residence shall have jurisdiction; in all other cases, the exclusive jurisdiction shall be that of the Court of Rimini.
